تعرب المنظمات الموقعة عن أسفها لـلنهج الإقصائي الذي اتبعته بعثة الأمم المتحدة في ليبيا خلال جلسات الحوار المهيكل، وتهميشها للأصوات الإعلامية والحقوقية المختصة وعدم الاستفادة من خبراتها وتجاربها المتراكمة في صياغة التوصيات التي تمس عصب العمل الصحفي، مما أدى إلى خروج التوصية رقم (19) بشكل قاصر ويفتقر للدقة القانونية وفقًا للحيثيات التالية:
المطالبة بتحديث قانون المطبوعات (1972) تعكس لغة قديمة تجمدت في السبعينيات وتتجاهل واقع الإعلام الرقمي والسمعي البصري؛ والصحافة بحاجة لقانون عصري شامل وليس لترقيع نصوص مقيدة.
جاءت الصياغة عائمة بالمطالبة بـمراجعة قانون الجرائم الإلكترونية (2022) وتحديثه بدلاً من النص صراحة على إلغاء أو تجميد مواده الفضفاضة والقمعية التي تُستغل لتكميم الأفواه.
لم تشر التوصية إلى نصوص قانون العقوبات المقيدة للحريات وقانون مكافحة الإرهاب (2014) التي تُوظف بانتظام لتقييد حرية التعبير وبعض القوانين الأخرى المتضمنة مواد قامعة لحرية التعبير.
أُفرغت التوصية من بنود حاسمة تتعلق بالأطر القانونية لحماية الصحفي، مثل النص صراحة على إلغاء العقوبات السالبة للحرية في قضايا النشر والتعبير، وحظر التوقيف الاحتياطي للصحفيين، وتحديد جهة مدنية مستقلة لتنظيم الإعلام، يجعل من هذه التوصية مجرد بيان نوايا شعاراتي لا يقدم أي حصانة حقيقية للعاملين في الميدان.
تؤكد المنظمات الموقعة أدناه على:
الرفض التام للصياغات المعزولة عن واقع ومطالب الصحفيين الليبيين.
تحميل البعثة الأممية المسؤولية الكاملة عن ضعف المخرجات نتيجة إصرارها على تغييب أهل الاختصاص.
المطالبة بإعادة صياغة التوصية (19) عبر فريق قانوني وإعلامي مستقل لمحاكاة المعايير الدولية وضمان بيئة انتخابية آمنة ونزيهة.

Statement Regarding Legislative Deficiencies and Flaws in the “Structured Dialogue” Recommendations Concerning Media Freedom
The undersigned organizations express their deep regret over the exclusionary approach adopted by the United Nations Support Mission in Libya (UNSMIL) during the “Structured Dialogue” sessions. This approach marginalized specialized media and human rights voices and failed to utilize their accumulated expertise and experience in drafting recommendations that affect the very core of journalistic work. Consequently, Recommendation No. (19) emerged as deficient and lacking legal accuracy, based on the following grounds:
The call to update the Publications Law (1972) reflects an archaic language frozen in the 1970s and completely ignores the reality of digital and audiovisual media. The Media is in dire need of a modern, comprehensive law rather than the patching of restrictive texts.
The drafting was vague in calling to “review and update” the Cybercrime Law (2022), instead of explicitly demanding the repeal or freezing of its broad and repressive articles, which are systematically exploited to muzzle voices.
The recommendation failed to reference the freedom-restricting provisions within the Penal Code, the Counter-Terrorism Law (2014)—which are regularly deployed to restrict freedom of expression—and various other laws containing articles that suppress free speech.
The recommendation was emptied of crucial clauses regarding legal frameworks for protecting journalists. Omitting explicit provisions that “abolish custodial penalties in publication and expression cases,” “prohibit the pretrial detention of journalists,” and “establish an independent civil body to regulate the media” renders this recommendation a mere sloganistic statement of intent that fails to provide any real immunity for media professionals in the field.
Therefore, the undersigned organizations affirm the following:
Our absolute rejection of drafts written in isolation from the reality and demands of Libyan journalists.
Holding the UN Mission fully responsible for the weakness of these outcomes, resulting from its insistence on excluding specialists.
Demanding the redrafting of Recommendation (19) by an independent legal and media team to align with international standards and guarantee a safe, fair, and secure electoral environment.
